Access to your case file
Helpful when…
You want to understand what the authority has recorded about your case, or what information sits behind a delay or decision.
What it is
Access to the authority’s file about your case. A lawyer can request it, read the material and help you understand what the authority is considering. [1]
How a lawyer can help
Identify the file.
Share the authority, case reference and the question you want to understand.
Request access.
The lawyer confirms their authority to act and requests access under the applicable rules.
Make sense of the material.
The lawyer reviews what is provided and explains relevant findings. Agree whether copies or a written assessment are included.
A helpful starting point
Your application or case reference, the name of the authority and any letters or decisions you have received. The practice will explain whether it needs a power of attorney.
What the law says
Section 29 VwVfG provides for access by parties who need the file to assert or defend their legal interests. It also protects certain internal material and other people’s private information. The procedure can involve federal, state or special rules. [1] [2]
Common questions
How is this different from a status enquiry?
A status enquiry asks how your application is progressing. Akteneinsicht lets you examine the material in the case file.
How will I receive the file?
The authority determines the arrangements for inspection. Your lawyer can request access and explain the material made available.
