Anwaltliches Aufforderungsschreiben
Formal letter requesting action
Helpful when…
You want a lawyer to formally ask the authority to decide your pending application, with a response date where appropriate.
What it is
A formal letter asking the authority to take a specific action. For a delayed application, a lawyer may ask it to issue a decision and explain why action is due. This is the service often described in English as an escalation letter. [1]
How a lawyer can help
Check the basis for the request.
The lawyer reviews what was submitted, any outstanding requirements and the authority’s replies.
Prepare and send the formal request.
The lawyer explains the requested action and, where suitable, gives a reasoned response date. Ask for a copy of the letter.
Review what happens next.
A reply, request for documents or continued silence can lead to different next steps. Agree whether that review is included.
A helpful starting point
Proof of your application, its reference number, the latest correspondence and any practical consequences of the delay.
What the law says
A lawyer may include a Fristsetzung: a date by which action or a reply is requested. Section 14 VwVfG covers authorised representation. Court action for a delayed decision has its own conditions under § 75 VwGO; a lawyer can assess those directly. [1] [2]
Common questions
What does Fristsetzung mean?
It means setting a date by which the letter asks the authority to respond or act. The lawyer chooses the wording and timing for your case.
Can a lawyer assess court action directly?
Yes. A lawyer can assess an Untätigkeitsklage under § 75 VwGO directly and discuss whether further correspondence would help.
